07-14 That the Township of McKellar accept the minutes of the January 8, 2007 Council meeting as circulated.

Carried

Visitors: Mr. Gord Zulak was present to discuss with Council the recent designation of the District of Parry Sound under the Aggregate Resources Act and requested that Council consider passing a motion objecting to the designation of the District of Parry Sound under the Act.

Mr. Paul Forth was present to discuss Application for Consent, file No. B42/2006 (Campbell) and Application for Consent, file No. B48/2006 (Hindle).

07-15 WHEREAS the Ministry of Natural Resources has designated a large area of the province including the Township of McKellar under the Aggregate Resources Act pursuant to Ontario Regulation No. 499/06;

AND WHEREAS the designation of the Municipality will now require all existing sand and gravel operations to obtain a license from the Ministry of Natural Resources;

AND WHEREAS there are a large number of small sand pits in the Municipality primarily used in connection with small contracting businesses for septic system and driveway installations for the local cottage industry;

AND WHEREAS sand and gravel resources occur only in isolated pockets in the local geography and where they do exist said deposits are generally shallow in depth and limited in quantity;

AND WHEREAS the Township of McKellar has sufficient safeguards in place to protect the physical, environmental and social impacts of the existing aggregate operations including its Official Plan and Zoning By-law all of which instruments were established with the required public consultation programs.

AND WHEREAS designating the Township of McKellar under the Aggregate Resource Act serves no public interest in the local economy, protecting the environment, or implementing provincial policy with the exception of establishing a redundant layer of bureaucracy with attendant fees;

AND WHEREAS the impact of the designation will have the potential to remove scarce resources from the community contrary to the provinces stated policies with respect to aggregate resources;

AND WHEREAS the designation will have the effect of causing a number of pit operators to abandon their pits and cease operations causing a burden to the local economy and consumers generally;

NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Township of McKellar hereby request the Minister of Natural Resources to remove the District of Parry Sound from being designated under the Aggregate Resources Act on the basis that there is no rationale, public or environmental interest being served by such a designation.

07-16 That the Township of McKellar approve Application for Consent, file No. B42/2006 (Campbell) subject to the various commenting agency approvals and the applicant providing evidence of septic approval prior to the Planning Board stamping the final deeds. All parkland provisions shall apply. Applicant shall meet the requirements of the Official Plan and Zoning By-law regarding access and setbacks. Resolution No. 06-276 is hereby rescinded.

07-17 That the Township of McKellar approve Application for Consent, file No. B48/2006 (Hindle) subject to the various agency approvals and the Township parkland requirements being met. The applicant shall submit an amended application to the Planning Board to remove Severed Lots 2 and 3 and the proposed right of access. The effect of this approval is for proposed Severed Lot 1. The applicant shall deed to the Township that portion of land 10 metres from the centre line of the travelled road as it abuts the proposed retained and severed parcels should a survey reveal an encroachment.

07-18 That the Township of McKellar hereby give By-law No. 2007-05, being a by-law to authorize the submission of an application for funding under the Rural Infrastructure Investment Initiative, First and Second reading.

07-20 That the Township of McKellar authorize the Clerk to attend the Bill 130 Training in Sudbury on March 1, 2007. Costs to be paid.
