Council Meeting Minutes October 16, 2006

Present: Reeve David Moore and Councillors Gerald Bell, Leonard Brown, Jury Naklowych and Debbie Zulak

06-255 That the Township of McKellar accept the minutes of the October 2, 2006 Council meeting as circulated.

Visitors: Mr. Dennis Lea was present to request permission to cross the road allowance between Concessions 1 and 2, in Lot 2 in order to construct a driveway to access his property. Mr. Lea stated that he would be applying to the Planning Board for a right of way across his southerly parcel if permission was granted,

Mr. Paul Beauregard was present to discuss with Council the Township maintaining and assuming the unassumed roads within the Township. Reeve Moore distributed a hand out of all the unassumed and seasonally maintained roads within the Township and outlined the Road Superintendent's concerns regarding taking over these roadways. Discussion ensued regarding the various options to achieve maintenance on these roadways.

Mrs. Myrna Fenton was present to discuss with Council the issue of maintaining Township unassumed roads and spoke in favour of the Township assuming these roads. Mrs. Fenton requested that Council pass a motion to assume the unassumed roads in the Peninsula Shores and Craigmore subdivisions.

Ms. France Desjardins was present to request that Council extend winter maintenance on the Fox Farm Road to the entrance to her property.

Ms. Shirlene Johnston was present to review with Council application for consent, file No. B35/2006 (Cole).

06-256 That the Township of McKellar approve Application for Consent, file No. B35/2006 (Cole) subject to the various commenting agency approvals, the applicant paying the parkland requirements and the applicant establishing the width of the proposed right of way at 66 feet. Approval also conditional on the applicant rezoning the proposed severed and retained parcels to the Waterfront 2 zone and the applicant deeding to the municipality that portion of road 10 metres from the centre line of Tait's Island Road should a survey reveal an encroachment.

06-257 That the Township of McKellar grant permission to the owners of Part of Lot 2, Concession 7, lying south of Little Ruebottom Lake, save and except Part 1 on Plan 42R-8527 to construct a driveway perpendicular across the unopened road allowance between Concessions 6 and 7 in Lot 2 subject to entering into an agreement with Township.

06-258 That the Township of McKellar hereby give By-law No. 2006-18, being a by-law to deem Lots 28 and 29, Plan M-225 in the Township of McKellar not to be part of a registered Plan of Subdivision, First and Second reading.

06-259 That the Township of McKellar hereby give By-law No. 2006-18, being a by-law to deem Lots 28 and 29, Plan M-225 in the Township of McKellar not to be part of a registered Plan of Subdivision, Third reading and Passed in Open Council this 16th day of October, 2006.

06-260 That the Township of McKellar approve application for consent, file No. B34/2006 (Barresi) subject to the various commenting agency approvals and the applicant rezoning the property to recognize the reduced frontage and lot sizes, reducing the maximum lot coverage to 10% and removing the permission to erect a sleeping cabin. All parkland provisions shall apply.

06-261 That the Township of McKellar have no objection and grant permission to the Dun-Ahmic Snow Riders to open up part of the concession allowance between Concession A and Concession 11 in Lot 33 for a snowmobile trail as outlined on the attached map. Responsibility for ensuring that the trail is established totally within the road allowance rests with the Snow Riders. The Township assumes no liability for work to be undertaken and requests the Township be named as an additional insured on the Snow Riders liability policy and a written release and indemnity agreement be entered into prior to commencement of the works. Dun-Ahmic Snow Riders recognize that this is public property and open to public use without permit.

06-262 That the Township of McKellar accept the quote of Tires 'R Us in the amount of $3,219.36 for the supply and installation of 6 tires and rims as per quote.

06-263 That the Township of McKellar adjourn to meet again on November 6, 2006 or at the call of the Reeve. Meeting adjourned at 11:05 p.m.
